These Terms and Conditions (“Terms”) govern your access to and use of the Website, as well as the purchase of any products, including our genuine Baltic amber jewellery imported from Poland. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or make a purchase.

1. Use of the Website

  • You must be at least 18 years old or have legal parental/guardian consent to use the Website.
  • You agree not to: (a) misuse the Website (e.g., hacking, viruses); (b) copy or reproduce content without permission; (c) use it for unlawful purposes.
  • We reserve the right to suspend or terminate access for violations.
  • All content on the Website (images, descriptions) is for informational purposes only and may not guarantee exact product appearance due to natural variations in amber.

2. Account Registration

  • To place an order, you may need to create an account providing accurate information (name, email, address).
  • You are responsible for maintaining confidentiality of your login details and notifying us of any unauthorized use.
  • We may suspend accounts for suspicious activity.

3. Orders and Payment

  • All orders are subject to availability and confirmation. We reserve the right to refuse or cancel orders (e.g., pricing errors, stock issues).
  • Product prices are in South African Rand (ZAR), excluding VAT (where applicable) and shipping. Final prices include these at checkout.
  • Payment methods: Credit/debit cards, EFT, or other secure options via our payment gateway (e.g., PayFast or PayU).
  • Ownership transfers upon full payment and delivery. Risk of loss passes to you upon dispatch.
  • Amber Authenticity: All jewellery features genuine natural Baltic amber sourced from Poland, certified by our suppliers. We provide a certificate of authenticity with each order upon request. Note: Amber is a natural fossil resin; color, clarity, and inclusions may vary, which is not considered a defect.

4. Shipping and Delivery

  • We ship nationwide within South Africa via trusted couriers (e.g., The Courier Guy or Aramex). International shipping from Poland to SA is handled by our importers.
  • Delivery times: 3-7 business days within SA; delays may occur due to customs or high demand.
  • Shipping costs are calculated at checkout. You are responsible for import duties/taxes if applicable (though intra-SA shipments typically incur none).
  • Track your order via the provided reference. We are not liable for delays caused by carriers or force majeure (e.g., strikes, weather).

5. Returns, Refunds, and Exchanges

  • In compliance with the South African Consumer Protection Act (No. 68 of 2008), you have a 10-business-day cooling-off period for distance sales (from delivery) to return unused items in original packaging for a full refund (excluding shipping costs).
  • Faulty or damaged items: Contact us within 48 hours of delivery for a replacement or refund. Proof of defect required.
  • Custom or personalized jewellery (e.g., engraved amber pieces) is non-returnable unless defective.

  • Amber jewellery complies with South African import regulations (e.g., SABS standards for jewellery) and EU export rules from Poland.
  • No other warranties, express or implied, including fitness for purpose. Amber’s therapeutic claims (e.g., pain relief) are traditional and not medically verified.
  • Product descriptions are accurate but may vary slightly due to handcrafting in Poland.

7. Limitations of Liability

  • To the fullest extent permitted by law, our liability is limited to the purchase price of the product.
  • We are not liable for indirect losses (e.g., lost profits, data loss) or consequential damages.
  • You indemnify us against claims arising from your misuse of products (e.g., improper wear causing injury).

8. Intellectual Property

  • All Website content, designs, and trademarks (including “Amber Jewellery” branding) are our property or licensed to us. Unauthorized use is prohibited.
